Data processing within the scope of pre-contractual and contractual relationships

We process third-party personal data transferred to us according to our contractual and pre-contractual agreements. These third parties are, among others:

The processing of this data, in terms of scope, type, purpose, and necessity, complies with the underlying contractual relationships. Transferred data is saved on our servers and processed. This transferred data includes your IP address, as well as any data you provide us so you can use these contractual services and any data we require to process them.

The data that is transferred is limited to the data needed and appropriate for processing inquiries. We will transfer personal data to external service providers only if it is required to render the service. In this case, we will also transfer to the external service provider only the data needed and appropriate for performance of the contract. We process the data under the directive of the third party or the statutory provisions. Purpose: Personal data is transferred to us and we transfer personal data to external service providers to effectively and promptly process inquiries. Legal basis: The transfer of personal data to us and any transfer of personal data to an external service provider by us shall be carried out pursuant to Art. 6 para. 1 lit. b) GDPR; the data shall be transferred for the purpose of contract execution between the third party and its contractual party. The transfer of data we have received to a third party for reasons other than contract execution shall be carried out pursuant to Art. 6 para. 1 lit. f) GDPR only if transferring the data is necessary to pursue our claims, or pursuant to Art. 6 para. 1 lit. c) GDPR, only if we have a legal obligation to do so. Erasure: Data is erased from our servers once the data is no longer needed for performance of the contract, for compliance with legal fiduciary duties, or for fulfilling any warranty obligations and comparable obligations. Statutory retention requirements remain unaffected.

Transfer of data to our subsidiaries

If you transfer personal data to us within the scope of a pre-contractual or contractual relationship, it may be transferred to servers at our subsidiaries who are located in and outside of the European Union. The data shall be saved and processed there.  We transfer all of the data that you have provided us for the purpose of utilizing our services.

The data transferred is limited to the data needed and appropriate for processing your inquiry. We will not transfer your personal data to other third parties. Our subsidiaries will transfer your personal data to other third parties only if this is required to utilize our services or if you have consented to the transfer. It will be ensured that your personal data is processed with the required level of security. Purpose: Your personal data is transferred to our subsidiaries for the effective and prompt processing of your inquiry and/or to render services within the scope of our existing contractual relationship. Legal basis: Your personal data shall be transferred to our subsidiaries pursuant to Art. 6 para. 1 lit. f) GDPR. Our legitimate interest in transferring this data lies in the fact that this is the only way to effectively and promptly process your inquiry and/or to ensure that the service is rendered within the scope of our contractual relationship. The data shall be saved and processed there.  We transfer all of the data that you have provided us for the purpose of utilizing our services.

Our external service providers shall transfer your personal data to other external third parties only if this is required to utilize our services. We have concluded an Agreement for Data Processing with our service providers. It includes data protection regulations that guarantee your personal data is processed by our external service providers with the necessary security and care. Purpose: Your personal data is transferred to our external service providers for the effective and prompt processing of your inquiry and/or to render services within the scope of our existing contractual relationship. Legal basis: Your personal data shall be collected and transferred to external service providers pursuant to Art. 6 para. 1 lit. f) GDPR. Our legitimate interest in collecting and transferring your data lies in the fact that this is the only way to effectively and promptly process your inquiry and/or to ensure that the service is rendered within the scope of our contractual relationship. The data shall be saved and processed there.  We transfer all of the data that you have provided us for the purpose of utilizing our services.

The data transferred is limited to the data needed and appropriate for processing your inquiry. We will not transfer your personal data to other third parties. Our external service providers, subsidiaries, and service and sales partners shall transfer your personal data to other third parties only if this is required to utilize our services. We have concluded an Agreement for Data Processing with our service providers. It includes data protection regulations that guarantee your personal data is processed by our external service providers with the necessary security and care. The external service providers we commission offer sufficient guaranties that when data is processed, it is done so at a level that complies with the data protection requirements of the European Union. Purpose: Your personal data is transferred to our external service providers, subsidiaries, and service and sales partners for the effective and prompt processing of your inquiry and/or to render services within the scope of our existing contractual relationship. Legal basis: Your personal data shall be collected and transferred to external service providers, as well as subsidiaries and service and sales partners, pursuant to Art. 6 para. 1 lit. f) GDPR. Our legitimate interest in collecting and transferring your data lies in the fact that this is the only way to effectively and promptly process your inquiry and/or to ensure that the service is rendered within the scope of our contractual relationship. Erasure: The erasure of data from our servers and from the servers of our subsidiaries and external third parties is carried out once the data is no longer needed for performance of the contract, for compliance with legal fiduciary duties, or for fulfilling any warranty obligations and comparable obligations. Video monitoring

Our company's premises are monitored by video. Video monitoring is used to prevent and provide information about theft, vandalism and other property damage, and to secure evidence, as well as to exercise our rights as the property owner. Erasure: In general, recorded footage is deleted after 72 hours. The only exceptions are cases in which there is sufficient suspicion that property was damaged or stolen. In such cases, the relevant image files are saved separately as proof and kept until conclusive information is determined, investigative proceedings are over, or the statute of limitations for the incident expires, whichever occurs first. Legal basis: Data is processed to safeguard our legitimate interests in protecting our property pursuant to Art. 6 para. 1 lit. f GDPR.

 

Web hosting

We make use of an Internet service provider to maintain our website. Our website is saved on the service provider's server (hosting) and the service provider makes our website available on the Internet. The Internet service provider processes on our behalf contact data, content data, contractual data, usage data, inventory data, and meta and communication data. Legal basis: The legal basis for the data processing described above is our legitimate interest in the efficient and secure provisioning of our website, pursuant to Art. 6 para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (Agreement for Data Processing).

If you use our website for informational purposes only, our Internet service provider will collect only personal data that your browser transfers to its server. This includes the following data:

  • Date and time of access to our website
  • Time difference between your time zone and Greenwich Mean Time (GMT)
  • Access status (HTTP status)
  • Volume of transferred data
  • Internet service provider of accessing system
  • Type and version of the browser you are using

The aforementioned data is saved as log files on the servers of our Internet service providers. This is necessary to be able to display the website on the device you are using, and to ensure stability and security. For the purposes mentioned above, our legitimate interest lies in data processing. Legal basis: The legal basis for this is Art. 6 para. 1 p. 1 lit. f GDPR. Duration: The aforementioned data used to make our website available to you is saved for 365 days and then erased. Restriction: Since the processing of the above data is mandatory for us to be able to make our website available to you, there is no right of appeal.

Cookies

Our website uses cookies. Cookies are small text files consisting of a series of numbers and letters, which are stored and saved on the device you are using. Making contact by completing our contact form

If you provide us with personal data by completing the contact form on our website, the data will be automatically saved by us and processed so we can process your inquiry. This data is used for the sole purpose of corresponding with you. The data is transferred via an encrypted SSL connection. Your data can be transferred to subsidiaries or service and sales partners located outside of the European Union if necessary to respond to your inquiry. Purpose: We need your name to be able to address you in our reply. We need your email address to be able to reply to your inquiry. We need your telephone number to be able to respond to your request for a callback. Legal basis: The legal basis for the aforementioned use of data is Art. 6 para. 1 lit. a GDPR. Erasure: The personal data we collect will be erased as soon as it is no longer needed. We check to see if the data is needed every two years. Use of your data during the application process

We use the talent management tool Cornerstone OnDemand, 1601 Cloverfield Blvd., Suite 620 South, Santa Monica, California 90404, USA on our website.

If you apply for a position with us, the personal data you submit during the application process will be sent to the Cornerstone OnDemand servers within the European Union (UK), processed there, and saved in a database. By accessing this database, we can obtain an overview of the applications received and can manage them. We have concluded an Agreement for Data Processing with Cornerstone OnDemand. It consists of data protection regulations that guarantee your personal data is processed by Cornerstone OnDemand with the necessary security and care. Cornerstone OnDemand has been awarded the ISO 27001 certificate, which serves as a guarantee and confirmation of compliance with data protection regulations. If your application results in an employment contract, we will save your data for the purpose of managing the employment relationship while complying with legal regulations. Registration

You can register on our website. To do so, you must enter personal data in the entry form. This data is also saved and processed by our Internet service provider and, if applicable, by us and can be modified or erased by you at any time. Newsletter

We send at regular intervals a newsletter to inform our customers, business partners, and prospective customers about our offerings and to provide news that is relevant to them. You can register for and give your consent on our website to receive newsletters. You must provide your email address when you register for our newsletter. We save your email address so we are able to send you the newsletter. Furthermore, we request the following data: form of address, last name, company, your industry (via a selection menu), city, country, and login password. This data is collected so that we can address you personally and customize the content of the newsletter to reflect your interests. Once you have registered for our newsletter, a confirmation email will be sent to the email address you provided when you registered as part of the double opt-in process. This email contains a link. By clicking on the link, you confirm that you want to receive the newsletter. This helps us ensure that when you registered, your email address is not misused by a third party. For the same reason, we save the date and time of your registration, as well as your IP address, at the time of registration. We will not transfer the aforementioned data to third parties. Sending newsletters via an email marketing service provider

We have commissioned the following email marketing service provider to send our newsletters: Cleverreach, Mühlenstr. 43, 26180 Rastede, Germany. The email marketing service provider may use your data in a pseudonymous form, meaning the data is not assigned to a user, to optimize or improve its own services, for example, to technically optimize how the newsletter is sent or displayed, or for statistical purposes. However, the email marketing service provider is not authorized to contact you directly or transfer your data to a third party. Legal basis: The email marketing service provider, on the basis of our legitimate interests, will lawfully send our newsletter pursuant to Art. 6 para. 1 lit. f GDPR and within the framework of an Agreement for Data Processing pursuant to Art. 28 para. 3 p. 1 GDPR.

 

Behavioral analytics

We analyze the cumulative user behavior when our newsletter is sent; we do not analyze the user behavior of individual recipients. To do this, our newsletters contain tracking pixels and tracking links. These help us identify if and when all recipients, in total, have opened the newsletter and if so, the links they clicked on in the newsletter. Purpose: We evaluate the newsletter as described above to be able to measure statistically the success or failure of our newsletter. Legal basis: The legal basis for processing your data is Art. 6 para. 1 lit. a GDPR. Restriction: You can withdraw your consent to receive the newsletter at any time by using one of the aforementioned options. Erasure: We erase your data when you withdraw your consent.

Your rights as a user of our website pursuant to the GDPR

  • Right to information: Pursuant to Art. 15 GDPR, you have the right to obtain a confirmation as to whether or not your personal data is being processed, and if so, which data is being processed. Furthermore, you can request the following information from us at no cost to you: purpose of the processing, the categories of personal data concerned, the recipients or categories of recipient to whom the personal data has been or will be disclosed, the envisaged period for which the personal data will be stored, the existence of the right to request rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing, the right to lodge a complaint, and any available information as to its source, insofar as we have not collected this information.   • Right to restriction of processing: Pursuant to Art. 18 GDPR, you have the right to obtain restriction of processing of your personal data where one of the following applies:

    • The accuracy of the personal data is contested by you for a period enabling us to verify the accuracy of the personal data
    • The processing is unlawful and you oppose the erasure of the personal data and request the restriction of its use instead
    • The personal data is no longer needed for the purposes of the processing, but it is required by you for the establishment, exercise, or defense of legal claims
    • You have objected to processing of your data pursuant to Art. 21 GDPR pending the verification of whether the legitimate grounds of us override those of you.

  • Notification obligation: If you have exercised the right to rectification or erasure of personal data or restriction of processing, we are required to communicate any rectification or erasure of personal data or restriction of processing to each recipient to whom your personal data has been disclosed, unless this proves impossible or involves disproportionate effort. We are obligated to inform you about those recipients.
  • Right to data portability: Pursuant to Art. 20 GDPR, you have the right to receive the personal data concerning you, which you provided, in a structured, commonly used, and machine-readable format, and you have the right to transmit the data to another controller.
  • Right to lodge a complaint: Pursuant to Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority. To do so you can contact the supervisory authority of your usual residence, workplace, or our corporate headquarters.

Conditions for consent

Pursuant to Art. 7 para. 3 GDPR you have the right to withdraw your consent to the processing of your data by us at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Right to object

You have the right to object, on grounds relating to your particular situation, at any time, to the processing of personal data concerning you, which is carried out based on an evaluation of interests (Art. 6 para. 1 lit. f GDPR). This applies in particular if the data processing is not required for performance of a contract. If you chose to assert your right to object, we ask you to name the reasons. We will then no longer process your personal data, unless we can demonstrate compelling legitimate grounds for the processing, which override your interests and rights.

Our website uses components of YouTube, a service of YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043-1351, USA.

By using YouTube, we are able to embed a variety of videos and clips that are made available on the www.youtube.de Internet platform. After you visit a page or subpage of our website with this type of embedded video or clip, the Internet browser you are using is prompted to download these embedded videos and clips. When you visit our website and its subpages, both YouTube and Google are informed about which page or subpage you have visited through the transfer of your IP address to the external Google servers in the USA. This information is transmitted irrespective of whether you actually view or click on the displayed videos or clips, or if you are logged in to your YouTube or Google account. Google is a participant in the Privacy Shield Accord and is certified to process data in accordance with European standards. This information is collected and linked to your Google account if you are signed in to it when you visit our website. Purpose: We use YouTube components on our website to make available videos and clips from www.youtube.de on our website for you to view and interact with.
